Appeal a Citation

A property received a citation, we've already evicted the guest. Now what? 

  1. Make sure the citation is paid > check here https://www.citationprocessingcenter.com/CitationSearch.aspx
  2. Request a Freedom Of Public Records Act to determine if we need to appeal or not. (speak to Mike Flannery) https://palmspringsca.justfoia.com/Forms/Launch/d705cbd6-1396-49b7-939e-8d86c5a87deb

3. File the citation in the property deal in HubSpot for record-keeping 

  • Responsible Party receiving an Administrative Citation may appeal such citation within ten (10) calendar days from the date the citation is deemed served.

4. File an appeal using this form> ADMINISTRATIVE CITATION APPEAL FORM 

This goes to a hearing officer.  You apply for that appeal based on the information on the back of the citation.  The case is heard by a single arbitrator hired by the City.

5. Send the appeal to > City of Palm Springs Administrative Citation Program
P.O. Box 7275 Newport Beach, CA 92658-7275 

6. Once Appeal is received, a Hearing Officer will be assigned to hear your Appeal. You will be mailed written notice to the address indicated on your Appeal, of the time and place for your Appeal Hearing. This notice will be mailed to you at least ten (10) calendar days prior to your hearing date.

 
 
 
  • Appealing a 3rd citation $911 and you have 15 days to file the appeal from the date the citation is mailed. (not received) The letter from the city tells you how to appeal to the City’s Administrative Appeals Board which is scheduled by City Clerk depending on how many cases the AAB has to review in the upcoming months.  The issue with this is the owner/agency must cancel all reservations for the next 6 months until the AAB hearing has been conducted.

3rd citation is a 2 year suspension.
